1. Introduction & Acceptance of Terms

Welcome to DrKKsaini.net. We provide educational advising, college counseling, and related support services (the “Services”).

These Terms of Use (“Terms”) govern your access to and use of our Services. By engaging our Services, whether through a consultation, package purchase, or other means, you, the client (and your parent or legal guardian, if you are a minor) (“you,” “your,” “Client”), agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.

2. Description of Services

Our Services are designed to provide guidance, information, and strategic advice on educational matters. Services may include, but are not limited to:

• High school course planning and extracurricular strategy

• College list development and selection

• Standardized test strategy (SAT, ACT, etc.)

• Application strategy and review

• Personal statement and essay brainstorming, editing, and feedback

• Interview preparation and coaching

• Financial aid and scholarship guidance

• Career and major exploration

Crucially, our Services are advisory in nature. We provide guidance, and expertise to support you in your educational journey. We do not write essays, complete applications on your behalf, or contact admissions offices for you.

3. Client Responsibilities & Academic Integrity

As a Client, you agree to:

• Provide accurate, complete, and honest information about your academic record, extracurricular activities, and personal background.

• Actively participate in the advising process, complete assigned tasks, and meet mutually agreed-upon deadlines.

• Uphold the highest standards of academic integrity. All application essays, personal statements, and other submitted materials must be your own original work. Our role is to provide feedback and guidance, not to create content for you.

• Communicate with us in a timely and respectful manner.

• Acknowledge that you are solely responsible for the final content of all application materials and for submitting them on time.

4. Fees, Payment, and Refunds

• Fees: Our fees for Services are outlined in our service packages or a separate Service Agreement. Fees are subject to change, but changes will not affect any package already purchased.

• Payment: All payments are due in accordance with the schedule outlined in your service package or agreement. Services may be suspended or terminated for non-payment.

• Refund Policy:

o Fees for hourly consultations are non-refundable once the consultation has occurred.

o For service packages, fees for services already rendered are non-refundable.

o If you choose to terminate a package before all services are rendered, a partial refund for unused, pre-paid services may be considered on a case-by-case basis, at our sole discretion. Any such refund will be prorated based on the hours of service already provided at our standard hourly rate.

o No refunds will be issued for a client’s decision not to apply to college or for dissatisfaction with admission decisions.

5. Confidentiality and Privacy

We are committed to protecting your privacy. All personal and academic information you share with us will be held in strict confidence. We will not share your information with third parties without your express consent, except as required by law. Please review our [Link to Your Privacy Policy] for a detailed explanation of how we collect, use, and protect your data.

6. Intellectual Property

• Our Materials: All materials, resources, worksheets, guides, and proprietary methods we provide to you are our intellectual property. You are granted a limited, non-exclusive, non-transferable license to use these materials for your personal, non-commercial educational planning purposes only. You may not reproduce, distribute, or share these materials with any third party.

• Your Materials: You retain all intellectual property rights to your personal essays, application data, and other materials you create. You grant us a limited license to review, edit, and use these materials for the sole purpose of providing our Services to you.

7. Disclaimer of Guarantees

You expressly understand and agree that:

• Our Services are provided on an “as is” and “as available” basis.

• We do not warrant, promise, or guarantee admission to any particular college, university, or program.

• We do not warrant, promise, or guarantee the receipt of any scholarship, financial aid award, or any specific academic or career outcome.

• Admissions decisions are made by independent institutions and are based on a multitude of factors beyond our control. Our role is to help you present your best possible candidacy, but the outcome is not guaranteed.

8. Limitation of Liability

To the fullest extent permitted by law, Dr KK Saini, its owner(s), and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of our Services.

In no event shall our aggregate liability for all claims relating to the Services exceed the total amount of fees you paid to us for the specific services from which the claim arose.

9. Term and Termination

• Term: These Terms become effective upon your engagement of our Services and remain in effect until the completion of the Services or until terminated by either party.

• Termination: You may terminate your use of our Services at any time by providing written notice. We may terminate or suspend our Services to you at any time for reasons including, but not limited to, non-payment of fees, a breach of these Terms, or unethical conduct (such as plagiarism or harassment).

• Effect of Termination: Upon termination, your right to use our proprietary materials ceases. The provisions regarding Fees, Confidentiality, Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law shall survive termination.

10. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of [Your State], without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Services shall be resolved through binding arbitration in [Your City, Your State], in accordance with the rules of the American Arbitration Association, rather than in court.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any significant changes by posting the new Terms on our website or by sending you an email. Your continued use of our Services after such changes constitutes your acceptance of the new Terms.
